The present contract is concluded between the seller (hereafter referred to as HELYS) and the buyer (hereafter referred to as the Customer), in the context of a mail order service.
The present general terms of sale concern sales by HELYS on its websites (www.helys.fr, www.helys-dna.com, www.helys-fingerprint.com, www.mon-adn.fr, www.mon-empreinte.fr, www.tableau-adn.fr).
All orders placed with HELYS imply explicit acceptance without reservation of the present general terms of sale.
The present general terms of sale, as well as prices, are explicitly accepted by the Customer, who declares and recognises he has perfectly understood them and consequently relinquishes the right to any claims based on a contradictory document, notably his own specific terms of purchase, the act of purchase automatically implying acceptance of the present general terms of sale and of the Royalty Licence Agreement. Prices, shipping costs and taxes
The prices indicated on the website, by email or in various HELYS advertising operations, are not binding and can be modified if a product is updated. Prices, which are established in Euros and include all taxes, are those valid at the time the order is placed. If, for whatever reason, an incorrect price is quoted to the Customer when ordering, the Customer can cancel his order.
For international deliveries, a flat shipping fee may be added to the total cost of the order. If this is the case, this fee is clearly indicated to the Customer during the order process.
For deliveries outside the EU, VAT is not billed during the order process. However, VAT and customs duties can be charged, depending on the country, when the merchandise clears customs.
The order is accepted by HELYS when it is confirmed by the Customer on the website and payment has been confirmed by HELYS.
For payments by credit card or bank transfer, confirmation means our banking partner has confirmed payment.
Shipment of the sample kit takes place after acceptance of the order by HELYS.
In compliance with article 121-20-2 of the French Consumer Code, a Customer who has purchased a personalised picture from HELYS can exercise his right to cancel his order.
Excerpt from article 121-20-2 of the French Consumer Code: “Right of withdrawal can only be exercised, except if the parties have agreed otherwise, for contracts [...] for the supply of goods made to order according to customer specifications or that are highly personalised".
Payments are made exclusively for the total amount of the order in Euros including all applicable taxes.
Any bank service charges for using of any of the means of payment offered by the Seller are supported by the Customer.
The Customer’s credit card is debited for the total amount of the order in Euros when the sample kit is shipped by HELYS.
For bank transfers, payments are collected on the day of the transfer.
In the case of a payment incident, HELYS reserves the right to suspend pending orders and refuse any new orders until complete payment of the sums owed.
HELYS agrees, when an order is accepted, to sell and ship to the address provided by the Customer, the product(s) selected by the latter within three to five weeks – starting from the date the samples (DNA or fingerprints) are received and confirmed by HELYS. A DNA sample is “confirmed” when it has been inspected by HELYS and exploitable DNA has been found on the swab.
Parcels are delivered by our partner shipping firm via Colissimo or Colissimo International. HELYS cannot be held responsible for delayed deliveries and Customers cannot make any claims for damages due to delays.
The Customer is responsible for inspecting the merchandise when it is delivered and before signing the delivery slip. In case of problems when the parcel is delivered, the recipient must mark any comments and reservations on the delivery slip. Any claims must be made in writing by registered letter with proof of receipt addressed to HELYS within 48 hours (working days).
Transfer of property rights
The Seller conserves total property rights concerning the products sold until they are paid for in full. However, once they are delivered, all risks due to loss or damages are transferred to the Customer.
Products sold on the HELYS website cannot be returned or exchanged, notably in the event the Customer is not satisfied with the visual appearance of the fingerprint or DNA profile (pattern or shape of bands, colour, number of bands per lane or picture, etc).
HELYS cannot be held responsible for damages, whether direct of indirect, of any kind resulting from the use of its products.
The Customer is prohibited from reselling HELYS products without explicit permission in writing from the company. Similarly, the Customer is not authorised to reproduce, in any form and on any media, notably digital formats, the DNA profile represented in the picture.
All orders placed by the Customer are for his personal use only or the personal use of the person to whom the product is delivered. In this last case, the Customer guarantees personal acceptance of the present General Terms of Sale by the person designated for delivery.
These General Terms of Sale are governed by French law. In the event of any claims stemming from application of the present contract, the parties agree to seek a solution together before taking legal action.
In the event of any legal claims, the court of Châlons en Champagne is the only competent authority.
